August Term, 1997 Argued: February 13, 1998 Appeal from a judgment of the United States District Court for the Southern District of New York (Michael H. Dolinger, Magistrate Judge) dismissing plaintiff's claim for severance benefits. We conclude that the complaint pleaded a claim for benefits under the Employee Retirement Income Security Act, 29 U.S.C. § 1001 et seq. (""ERISA""), that plaintiff's state law claims were preempted, and that under ERISA plaintiff had no right to jury trial. Affirmed.
